Determining Legal Responsibility for a Motorcycle Accident
Your lawyers' investigative team is responsible for researching the events involved in a motorcycle accident to determine if there is sufficient cause to file a lawsuit to claim damages. Experienced lawyers are able to evaluate the information gathered, and determine the extent of damage and the value of the loss suffered by the claimant. Of the many factors that need to be investigated the most common ones include: - Were there any defects in the roadway designs?
- What were the weather conditions?
- Were there any defects in the motorcycle's brakes or tires, helmets, or other protective gear?
- Was the other driver negligent in any way, including recklessness, distraction, or intoxication?
- Were there other contributing factors, such as a child, animal or object suddenly entering the roadway?
One common mistake is a bias that often presumes motorcyclists are at fault in accidents involving other motorists. But, since licensed motorcyclists are legal drivers of legal vehicles, they have the same rights as other drivers, as well as responsibilities. Experienced motorcycle accident lawyers can help you establish your credibility and preserve your rights, as well as your responsibilities, if you are the victim of a motorcycle accident. The attorneys at Findlay Law Offices are experienced in investigating the physical evidence, interviewing witnesses, and other factors that determine responsibility in motorcycle accidents. If you have been involved in a motorcycle accident in Ontario, please contact us today for a free consultation.

Cerebral Palsy and Medical Malpractice
Cerebral palsy can still occur despite the best of medical care. But when cases are caused by a health care provider's negligence, there may be grounds for a lawsuit. Such errors can occur either during the birth or during the newborn's care prior to discharge. Common delivery mistakes that cause cerebral palsy include, and may be indicated by: - Severe oxygen deprivation to the brain that resulted from:
- The child remaining in the birth canal too long
- Failure to recognize and treat seizures following delivery
- An undetected prolapsed cord or nuchal cord
- Failure to perform a cesarean section in the presence of fetal distress
- Non-response to changes in the fetal heart rate
- Failure to plan a cesarean section for a large birth weight infant
- CPR required after birth
- Failure to respond to the mothers changing conditions, such as high blood pressure or toxemia
- Failure to diagnose and treat jaundice in a timely manner
- Failure to diagnose and treat meningitis in a timely manner
- Excessive use of vacuum extraction
- Improper use of forceps
- Emergency cesarean section
- Emergency transfer to neonatal ICU (NICU)
- The occurrence of seizures
- The need for MRI, brain scan or other special diagnostic testing
- The infant required oxygen or respiratory support after birth
If your child has cerebral palsy, and if any of the above was a factor in the birth of your child, it may indicate a medical error as the cause. The monetary, medical, physical and emotional costs of meeting the specialized needs of a child with cerebral palsy can continue throughout your child's life. If your child is the victim of cerebral palsy, please contact Findlay Law Offices for a free consultation if you live Ontario. You may be entitled to damages if this was caused by a medical malpractice error.

Proof of Damages in TBI Cases
Proving damages in traumatic brain injury (TBI) cases goes beyond proving that a TBI occurred. It involves determining the extent of the injury, the costs and losses the client has suffered, and estimating future medical expenses. The difficulty in doing this comes from the complexity of the brain itself. Effects from damages can manifest immediately, or delay until long after the injury took place. Care and rehabilitation costs can be substantial. The victim's remaining lifetime earnings may be lost, or seriously reduced. Even when the victim is able to continue working, injuries may affect vision, sleep patterns, headaches, irritability, or a variety of behaviors, even inhibition. Other considerations are current and future medical expenses, pain and suffering, loss of enjoyment or quality of life, loss of earning capacity, disability or loss of health, or aggravation of a pre-existing injury. If you or a loved one has suffered traumatic brain injury caused by an accident or malpractice, visit a qualified attorney as soon as possible. The sooner an investigation is initiated, the more information can be recovered thoroughly and accurately to establish your claim. The lawyers at Findlay Law Offices have special expertise and specialized medical knowledge in the area of brain injuries. We are prepared to help you obtain full, fair and just compensation. Please contact us for a free consultation if you live in the Hamilton or Toronto areas of Canada.

TBI in Children
Traumatic brain injury (TBI) refers to injuries other than those in infants born with a brain injury. It also is not used for brain injuries that occur during birth. More than one million children receive traumatic brain injuries (TBI) each year in the USA (almost half of all TBIs). More than 30,000 of these children have lifelong disabilities as a result of the brain injury. Traumatic brain injuries can cause changes in one or more areas, such as: - Thinking and reasoning
- Word comprehension
- Memory
- Attention span
- Problem solving
- Abstract thinking
- Speech
- Behavior
- Coordination affecting walking and physical movement
- Vision
- Hearing
- Learning
Among children ages 0 to 14 years, TBI also results in an annual estimate of 2,685 deaths, 37,000 hospitalizations, 435,000 emergency department visits. If you or a loved one has suffered a traumatic brain injury, whether as the result of an automobile accident, bicycle collision, fall, playground mishap or other cause, it is critical that you contact a brain injury lawyer as early as possible following the injury. The lawyers at Findlay Law Offices have special expertise and specialized medical knowledge in the area of brain injuries. We are prepared to help you obtain full, fair and just compensation.
