Wrongful Death

Wrongful death is legal terminology that refers to the death of an individual that has died due to the negligence or misconduct of another individual, with that death entitling the victim’s survivors or dependents to financial compensation for their loss.

The devastating loss of a loved one is impossible to replace, therefore, the only tangible measure the legal system can employ to gauge your loss is financial compensation. A claim of wrongful death is the basis for a lawsuit against an individual or entity that is said to have caused the death, on behalf of the survivors or dependents that have lost the support and comfort of the deceased.

The legal issues surrounding a wrongful death claim are complex and have time limits applied to them. Only an experienced wrongful death attorney has the expertise to evaluate your claim and guide you through the complicated process of obtaining justice for you and the ones you care about.

Financial compensation in a wrongful death claim may include payments for medical, funeral and burial expenses, payments for the pain and suffering of the victim prior to death, the loss of financial support for the survivors and compensation for their pain and suffering also.

Preventing a Traumatic Brain Injury

The leading causes of traumatic brain injuries are motor vehicle accidents, falls, sports injuries and assaults. Falls are the major cause of traumatic brain injury in young children and adults over seventy-five years of age. Many cases of traumatic brain injury cause permanent disability and death every year.

Traumatic brain injury risks are greatest for young children, young adults and the elderly. The highest risk group is young men aged fifteen years to twenty-four years old. Men are more likely to engage in risky behaviors, such as driving cars and motorcycles at high rates of speed, participating in contact sports and engaging in the use of firearms.

To prevent a traumatic brain injury it is important to wear your seatbelts when driving or riding in an automobile and to also buckle your children into an age-appropriate safety seat. Wear a helmet when riding a motorcycle, or a bicycle, skating or skateboarding, skiing, sledding, playing football or hockey, or horseback riding. Keep firearms locked away in a cabinet or safe.

You can also try to prevent falls by using good judgment and common sense. Use a step stool to reach objects on high shelves, install handrails on stairways, install window guards to prevent children from falling out and use shock-absorbing materials in play areas.

If you live in Hamilton or Toronto, Ontario, Canada or the surrounding area and you or someone you care about has suffered a traumatic brain injury, please contact the injury lawyers at the Findlay Law Offices in Hamilton, Ontario today to schedule a confidential consultation at no cost to you to protect your rights and interests.
