What to Do When Someone Leaves the Scene of an Accident

Each year more than 1 million vehicles are involved in injury accidents across Canada. Approximately 400,000 thousand drivers are involved in collisions involving property damage or injuries in Ontario. If you are involved in an auto accident, you are required to stop. Failure to do so may result in criminal as well as civil charges.

While specific penalties vary from province to province, the basic law states that you should never leave the scene of an accident. A driver involved in an accident must:

  • Stop the vehicle
  • Render assistance to those who need it
  • Leave contact information at the scene

Guilty parties who leaves a scene of a fatal accident may be charged with murder and even receive a life sentence.

If you witness an accident where one of the drivers fails to stop, report it immediately to the police. If possible, note the license number and the description of the vehicle. As a witness, you should also try to render assistance if necessary. Witnessing an accident and failing to stop may also lead to criminal charges.

If you or someone you know is involved in an accident, please contact the auto accident attorneys at Findlay Law Offices to review your legal options. We serve Hamilton and Toronto and surrounding areas of Ontario.

Rules of Conduct at the Scene of an Accident

Being involved in an accident is a harrowing experience. When an accident occurs, the adrenaline rush can often cause you to forget key the basic rules of conduct that should be followed at the scene of an automobile accident. Only constant review of what to do in case of an accident will allow you to recall them when you need them.

  • Do not leave the scene of an accident
  • Never admit fault
  • Call the police and follow their instructions
  • Do not move the vehicle until the authorities have an opportunity to survey the scene
  • Exchange information with the other driver
  • Seek medical help if you feel you need it
  • Write a narrative of the accident while the details are still fresh in your memory

When speaking with the other parties involved in the accident, never agree to handle it amongst yourselves. The authorities will provide an adequate record of the accident in case legal proceedings develop later on. The police and medical records may be needed to bolster your case.

If you or someone you know is involved in an accident, these tips can help protect you legally. To find out more, please contact the auto accident attorneys at Findlay Law Offices, serving Ontario, today.

Airbag Injuries

Airbags are special, computer-controlled safety devices that are designed to come between you and the components of your vehicle like the steering wheel, or dashboard in the event of certain types of car accidents.

Airbags inflate at a high velocity when triggered by accidents, primarily involving the front of the vehicle. The speed of airbag deployment is linked to certain injuries, even death, especially in smaller passengers.

During a typical accident up to four collisions may occur:

  • The initial collision occurs between the vehicle and other object
  • The second collision occurs between an unrestrained occupant and the interior of the vehicle
  • The third collision involves the internal organs and the occupants skull or chest wall
  • The fourth involves other objects inside the vehicle

Any of these collisions can cause serious bodily injury. Airbags are designed to limit damage causes during the second type of collision. Smaller people, especially children are more susceptible to injury from airbag deployment.

In some cases, the airbag should be turned off or disabled when smaller individuals are driving or riding as passengers. Modern vehicles are equipped with mechanisms to detect the weight of the occupant or can be disabled using the ignition key when a lighter passenger is riding in the vehicle.

If you, or someone you know has suffered injury due to airbag deployment, please contact the auto accident attorneys at Findlay Law Offices, serving the Ontario area, to find out about your legal options.

Hydroplane and Loss of Control Accidents Due To Rain/Ice

Adverse weather conditions play an important part in any motor vehicle accident. One of the most common types of accident in bad weather is the hydroplane and loss of control accident due to rain or ice. Many factors contribute to hydroplaning on slick roads including:

  • The amount of water or ice on the road
  • Visibility
  • Speed
  • Inadequate or defective tires

Cars rely on friction between the tires and the road to perform basic functions like turning, braking, and acceleration. Tires are designed to dissipate water on wet roads to ensure that the tire remains in contact with the road. If there is more water on the road than the tires can dissipate effectively, the car may rise off the road and ride on the sheet of water instead, which is hydroplaning.

Once a car starts hydroplaning, there are only a few things you can do to prevent a serious accident:

  • Slow down - Allow the tires to re-grip the surface of the road, do not slam on the brakes however, as this only makes matters worse.
  • Avoid overcorrecting - Once you find yourself hydroplaning, do not jerk the wheel. If you are sliding, turn into the direction of the slide.

If you or someone you know was involved in a hydroplaning and loss of control accident due to rain or ice, please contact the experienced auto accident attorneys at Findlay Law Offices. We serve Hamilton, Toronto and surrounding areas of Ontario.

Common Auto Accident Injuries

Every automobile accident is different. The type of accident, the speeds involved, and whether or not you were wearing your seatbelt will all contribute to the nature and severity of injuries incurred. Many accident injuries can lead to permanent disabilities and lost income. Even relatively minor problems can lead to reduced abilities for which you should be compensated.

Some common auto accident injuries include:

Regardless of the type of accident you are involved in, you should seek medical attention to ensure that you are really ok. The increase in adrenaline following an accident can mask symptoms of serious underlying injuries about which you may not be aware. If left untreated, these injuries may worsen and result in a debilitating condition.

In most cases, under Canada's "no fault" insurance protection laws, you can seek relatively quick and adequate compensation for medical treatment. However, it may be more difficult to be compensated for severe injuries that cause a loss of income or result in disability. The law does allow you to seek additional compensation using tort law for pain and suffering and lost wages.

To find out more about your options with tort law related to common auto accident injuries, please contact the auto injury attorneys at Findlay Law Offices today. We serve Hamilton, Toronto and surrounding areas of Ontario.
