Disability Claims Questions
I was recently denied long-term disability benefits. When should I hire a lawyer?
You should contact an experienced disability claim lawyer immediately after the insurance company denies your claim.
Why is the insurance company refusing to pay my long-term disability claim when I am clearly disabled and unable to perform my job duties?
Many insurance companies try to deny your claims by suggesting that there isn’t sufficient evidence of a disability, or that your specific condition isn’t justifiable and therefore, not subject to benefits. Your lawyer can retrieve documentation from your doctor to help prove your case.
Do insurance companies really sneak around, videotaping people who file disability claims?
Yes, so be aware. Insurance companies will try to record you doing an activity you claim you can not because of your condition, in an effort to prevent insurance fraud. Don’t allow them to deny your claim by exaggerating your disability.
If I’m unable to work at my current job, am I still entitled to benefits if I can train for another job?
Most policies specifically cover you for the job you had the day you became insured. These policies are called “own occupation.” If you have a policy like this and aren’t able to do your job, you can collect benefits even if there are different jobs your condition allows you to do.
What if the insurance company terminates my benefits while I’m still disabled?
Request that your doctor give your insurance company with written documentation of your continuing disability. Then ask your insurance company to respond in writing to your request for reconsideration. If that fails, talk to a highly skilled disability claim lawyer.
Do I have to continue paying premiums to keep my disability insurance policy active while I’m disabled?
No, under most circumstances. But it depends on how your policy reads. Review your policy in detail, and know your rights. When in doubt, pay the premium. Your insurance company must refund you any premiums you paid while you were disabled if you have that type of policy.
